1. Who these terms apply to
These terms apply to anyone who orders, pays for, or uses a product or service from X IT ("we", "us", "our"), whether through our website, over the phone, by email, or in person. Placing an order or making a payment means you accept these terms.
2. Our services
X IT provides web and app development, e-commerce platforms, POS software, ERP and CRM solutions, digital marketing, and related custom software services, as described on our Services page and individual product/order pages. Exact scope, features, and pricing for any project are as agreed at the time of order or in a written quotation.
3. Orders and payment
Orders are confirmed once we receive payment (in full or per the agreed schedule) and your order is verified by email OTP. Accepted payment methods are listed on our How to Pay page. Prices shown on the website are in Bangladeshi Taka (৳) unless stated otherwise, and may be revised for a project if the agreed scope changes.
4. Delivery and timelines
Delivery timelines given at the time of order are estimates. Actual delivery depends on factors including how quickly you provide requested content, feedback, and access (e.g. domain, hosting, API credentials). Delays caused by late client input are not considered a delay on our part.
5. Client responsibilities
You're responsible for providing accurate order details, timely feedback, and any content, credentials, or third-party access we need to complete your project. You're also responsible for the legality of any content, product, or business you ask us to build software for.
6. Intellectual property
Unless otherwise agreed in writing, ownership of custom-developed source code and deliverables transfers to you once payment for that work is received in full. Until then, all work remains the property of X IT. Reusable internal tools, frameworks, and components we've built prior to your project remain our property even after handover.
7. Refunds
Refunds are handled under a separate Refund Policy, which forms part of these terms.
8. Third-party services
Some services depend on third parties outside our control — payment gateways (such as bKash and SSLCommerz), hosting providers, domain registrars, SMS and email delivery networks. We aren't liable for outages, delays, or issues caused directly by these third parties, though we'll help you resolve them where we can.
9. Limitation of liability
We build software carefully and stand behind our work, but we don't guarantee specific business outcomes (such as sales, traffic, or rankings) resulting from using our products or services. To the extent permitted by law, our liability for any claim is limited to the amount you paid us for the relevant service.
10. Changes to these terms
We may update these terms from time to time. Changes apply to orders placed after the update is published here. The "last updated" date at the top of this page reflects the latest revision.
11. Governing law
These terms are governed by the laws of Bangladesh.
